The Peach State's business court is designed to handle the same types of cases as the business courts in other states, and lawyers told Law.com they've had positive experiences litigating there. However, while other courts report new filings in the triple digits, Georgia's State-Wide Business Court only had 25 new cases filed in the last year.

According to the lawyers Law.com spoke to, there are a few factors fueling the exodus, tied to developing trends in the industry and "seismic changes on the corporate level," in the words of former Weinberg Wheeler Hudgins Gunn & Dial attorney Shane O'Neil.

"This is about seeking an arrest warrant against a private citizen by a private citizen, and this proceeding has dragged on for years now. I don't think that's something Scapa Dryer Fabrics v. Knight had in mind when it created these proceedings," appellant attorney Andrew Fleischman of the Sessions Law Firm told the Georgia Court of Appeals.

Gwinnett County State Judge Rhonda Colvin ruled that the plaintiff's roughly four-hour round trip to court would not be enough to keep her from suing in her venue of choice.

As the case moved forward, "The discovery … uncovered a lot of criminal activity [and] under-funding of security and repair by management. So that became the main theory of the case," plaintiffs' attorney Adam Hoipkemier told Law.com.

The paralegal said there wasn't a clear path to report an ethics concern at his firm.
