Applications to dismiss claims for want of prosecution generally involve three related considerations: the extent of the delay, whether it is satisfactorily explained, and the prejudice it causes the opposing party. These factors are not applied mechanically. In Primall Media (Pty) Ltd v iPoint Marketing CC and Others (7236/2013) [2026] ZAGPJHC 435 (22 April 2026), the court emphasised that the ultimate enquiry is whether, in all the circumstances, it would be unfair or unjust to allow the matter to proceed.
